By creating an account or using CongregateHQ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Lagniappe Web Solutions ("we," "us," "our").
If you are using the Service on behalf of a church or organization, you represent that you have the authority to bind that organization to these Terms.
CongregateHQ provides churches and religious organizations with:
SMS messages are delivered via Telnyx, a third-party telecommunications provider. Message delivery is subject to carrier conditions and is not guaranteed in all circumstances.
To use CongregateHQ you must create an account with a valid email address and password. You are responsible for:
Each account is for use by a single church or ministry organization. You may add team members to your account per your plan's seat limits.
You may only use CongregateHQ to send messages to individuals who have explicitly consented to receive communications from your church. Prohibited uses include:
You are responsible for compliance with the Telephone Consumer Protection Act (TCPA) and all applicable federal, state, and carrier regulations regarding SMS messaging.
Opt-out handling: CongregateHQ automatically processes opt-out replies including STOP, QUIT, UNSUBSCRIBE, CANCEL, and END, and adds those numbers to your Do Not Contact list. You must not attempt to override, remove, or bypass these opt-outs without verifiable written re-consent from the recipient.
Required disclosures: When collecting phone numbers for SMS, you must clearly disclose that the individual will receive text messages, the message frequency, that message and data rates may apply, and how to opt out.
SMS disclaimer required on all forms: Any form used to collect phone numbers for SMS purposes must include the following or equivalent language:
Carrier compliance: Messages must comply with all applicable carrier guidelines including CTIA standards. We reserve the right to review and disable message campaigns that violate carrier policies.
Subscriptions are billed monthly or annually in advance. By providing a payment method, you authorize us to charge your selected plan fee on a recurring basis until you cancel.
Refunds: We do not offer refunds for partial billing periods. If you cancel mid-month your account remains active through the end of the paid period.
Price changes: We will provide 30 days notice of any price increases via email before the change takes effect on your account.
Each plan includes a monthly credit allocation. One credit equals one SMS message segment (up to 160 characters) to one recipient. Credits:
MMS messages (with images) use 2 credits per recipient. Messages over 160 characters use additional credits per additional 153-character segment.
You may cancel your subscription at any time from your account dashboard under Billing. Cancellation takes effect at the end of the current billing period.

CongregateHQ and Lagniappe Web Solutions are not liable for:
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
We reserve the right to suspend or terminate your account immediately and without refund if:
We will make reasonable efforts to notify you before termination except where immediate action is required to prevent harm or comply with carrier requirements.
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
